This document, which you have just accessed for the purposes of searching or purchasing products (hereinafter, “Online Store”), regulates the General Terms & Conditions of Use for the Online Store (hereinafter “General Terms & Conditions”) of WILD NUT CO, Unipessoal Lda., Legal person with the number 514879556, headquartered at Rua Horta Machado nº14, 8000-362 Faro.

All information provided by the Client must be accurate and true. The Customer is obliged to update the information provided to I’M NAT ™, whenever it changes. The Customer is expressly responsible for any false or inaccurate statements it makes and for any losses it causes to I’M NAT ™ or third parties, with the information it provides.

I’M NAT ™ is the entity responsible for processing the personal data of its customers, whose legal basis for processing is the execution of this purchase and sale contract.

In the event of a breach of the General Terms & Conditions, I’M NAT ™ reserves the right to exercise any and all legal actions provided for. In addition, I’M NAT ™ reserves the right, at its discretion, to terminate access to or use of the Online Store, with or without notification from the Customer.

I’M NAT ™ applies the appropriate technical and organizational security measures necessary to ensure information security. However, it is known to the Customer that the use of the Online Store may not be 100% secure, so there is a possibility that the information sent / received may be intercepted by unauthorized parties, and this cannot be attributed to I’M NAT ™.

The contractual proposal contained in the Online Store is aimed only at persons of legal age, accepting the Customer who can only be used by users over eighteen years old and / or with full contractual capacity and who, therefore, can be responsible for the commitments resulting from the buy and sell.

II. Online Purchase Procedure

1st Step: Selection of items to include in your shopping cart (whose price is indicated in Euros, including VAT at the legal rate in force).

The Customer hereby accepts and expressly acknowledges that:

·       The images of the articles presented in the online store are for illustrative purposes only and the Client must read carefully and fully read the information on the essential characteristics of the articles, being able, in case of doubt, to contact the support line by telephone or by email. to the I’M NAT ™ customer for any additional information or details;

·       I´M NAT ™ will make every reasonable effort to include accurate and up-to-date information about its products available on the I’M NAT ™ website;

·       The prices of the items indicated in the Online Store correspond to the full amount to be paid by the Client, being completely independent of the possible price fluctuation practiced by physical stores resellers of I’M NAT products.

2nd Step: Registration / Form Filling

For the purpose of confirming your order online, the Customer will have to fill out a form, in which he must indicate:

·       Full name / corporate name of the Client;

·       Customer contacts and email addresses;

·       Customer TIN / NIPC;

·       Select the delivery method;

·       Full name of the person who will receive the order;

·       Complete delivery address for the order;

·       Full name or corporate name of the Client to appear on the invoice;

·       Customer TIN / NIPC to appear on the invoice;

·       Customer’s address shown on the invoice.

The Client guarantees the veracity and accuracy of the data provided when filling out the contract forms, being responsible for the damages caused to I’M NAT ™ resulting from their incorrectness. The Client undertakes to notify I’M NAT ™ in writing of any change in the personal data provided that occurs during the term of this contract.

3rd Step – Confirmation of items and services included in the shopping cart, Buyer Data and Billing and Payment Data

The Customer undertakes to carefully check the data contained in his order summary, confirming the items and services selected in the shopping cart, Customer data and billing data, and at that time must return to the previous steps in order to proceed with the respective rectification. if it detects any non-conformity.

The Customer must select the payment method: Paypal, Mbway, ATM reference or MASTER CARD or VISA credit card, whose data to be collected are: card number, expiration date and CSV code.

After completing the previous steps and confirming acceptance of the General Terms & Conditions, the Customer will have the possibility to activate the “CONFIRM ORDER” button.

I’M NAT ™ will acknowledge receipt of the order by email sent to the email provided by the Customer. Once payment is confirmed by I’M NAT ™, the respective invoice will be sent when the purchased items are sent.

As alterações posteriores aos atuais Termos & Condições Gerais não vinculam o Cliente. O Cliente deverá imprimir uma cópia deste documento na data da sua compra para registo futuro. O presente contrato formalizar-se-á em língua portuguesa.

III. Home Purchase Delivery

Carrier Delivery:

Delivery of Items / Transportation

In case of unavailability of the item (s) for delivery, I’M NAT ™ must inform the Customer, within a maximum period of 30 (thirty) days from the knowledge of this unavailability, proceeding to the refund of the amounts paid, Parties do not agree on a new deadline for implementing the agreement.

If the Customer is not available to receive the items on the scheduled date and time window, he must contact I’M NAT ™ and indicate a possible date for delivery, to take place within a maximum period of 3 (three) days, counted from the reference date for delivery.

If it is not possible to deliver the goods under the responsibility of the Client, the costs related to the second deliveries will be borne by the latter, at the value of the applicable transportation table. If, on the agreed date and time window for Delivery, the Customer is absent from the agreed location, the order will return to the possession of I’M NAT ™ to schedule the next delivery to the customer under charge of reshipment and other costs inherent to the same.

The Customer has 72 hours to schedule a new delivery.

Additionally and regardless of whether the delay in Delivery is due to the Carrier, once the aforementioned 72-hour period has elapsed, counting from the date scheduled for Delivery, without the Client having scheduled a new Delivery, I’M NAT ™ has the right to terminate the Contract, communicating to the Client the resolution and returning to the Client the value of the purchased goods.

In case of resolution of the agreement, under the terms of the previous paragraph, the Customer will not be refunded the amount paid for the attempt to deliver the order.

The scheduling of a new date for the provision of the Service is subject to the availability of the delivery service.

In the event that the second installment of the Service takes place on a different day than the one originally scheduled, the Client is responsible for paying the amount for the second installment of the Service, the amount already paid for the first installment of the Service not being refunded, according to the price exposed on the I’M NAT website and store available to the Client. The Customer will also be able to consult the price list through the Customer Support Service, through email or telephone contact.

In case of detecting defects or damages in the articles and / or if the articles do not match your order, the Customer must identify the damages or defects by e-mail, using photographs that prove it.

The customer should also contact I’M NAT ™ for Customer Service +351 289 013 073 (Monday to Friday: 9 am-6pm), as soon as possible.

Delivery by CTT:

Delivery of Items / Transportation

When subscribing to this provision of services, the Client should keep in mind that the delivery of orders via CTT is limited to the weight of 30 kg (thirty kilograms).

The delivery of the order will take place within the estimated time announced, at the time of the purchase conclusion, between 9 am and 7 pm.

In case delivery is not possible on the estimated date, CTT will make the best efforts to proceed with the new delivery. Likewise, in case the second delivery attempt proves to be unsuccessful, the order will be forwarded to the nearest CTT post, where it will remain for 5 (five) working days.

After these 5 (five) working days, without the customer picking up the order at the CTT post closest to the postal address indicated for delivery, the order will be forwarded to the address of I’M NAT ™ and will not be returned to you the value of the items ordered as well as the cost of sending the order.

Delivery verification

Upon receipt of the goods, the Customer must immediately check the condition of the packaging.

CTT will only accept claims for damage to the order if the original packaging of the order is made available to you, so it is essential that the Customer keeps the packaging.

At the time of delivery, the Customer must check all the goods contained in the packaging, the correspondence between the references of the purchased items and the references of the delivered items, the quantity and the status of them. In case of detecting defects or damages in the items and / or if the items do not match your order, the Customer must identify the damages or defects via e-mail, and contact I’M NAT ™ for the Support Service Customer +351 289 013 073 (Monday to Friday: 9 am-6pm).

V. Exchanges and Returns

Unfortunately, we do not accept product returns or exchanges of products.
If your order was damaged in transit or if you’ve received the wrong order, please contact our Customer Service team immediately,
sending an email to hello@iamnat.pt or calling +351 289 013 073, and we
we will send you a replacement or offer you an equal exchange credit.
If you believe there is a quality issue with your product, check the Delivery Date
Validity and Lot Code (to be able to verify when the product was created),
so that we can track the specific lot of the product you received. These inquiries
will be handled on on a case-by-case basis.

VI. Complaints

The Client may address any complaints to I’M NAT ™, through the contacts available on the website at iamnat.pt, through the e-mail hello@iamnat.pt, or through postal correspondence to be sent to the following address: I’M NAT, Bela Salema, PO Box 237D, 8005-419 Faro.

VII. Applicable Law and Venue

For any divergence in the contractual relations between the Parties, Portuguese law will apply. Any question or dispute arising from the application, interpretation, integration or performance of this Agreement, when it cannot be resolved by agreement of the parties, will be submitted to the Portuguese courts. Consumers will be able to seek information about their rights from the Alternative Dispute Resolution Entities, available at www.consumidor.pt

In the event of a consumer dispute, the consumer may use the network of consumer dispute arbitration centers authorized to pursue the information, mediation, and arbitration of consumer disputes activities.
