PRELIMINARY NOTE
Here you will find all the necessary information regarding the use of personal data of our visitors, users (which include: users who abandon their shopping cart, internet users who communicate with I’M NAT through the channels available in the online store – Instagram, Facebook and Email) and buyers, hereinafter referred to as users.
We permanently place all the information included in this Privacy and Cookie Policy on our online store.
1. WHY DO WE PROCESS YOUR PERSONAL DATA?
The data collected is not used in the same way, and each situation requires the use of different methods. Below you will find a list of the data collected and used by I’M NAT:
• Identification details: first name, last name, language and country, contact details (i.e., email and phone or mobile number);
• Shipping information: address, postal code, city and country;
• Billing information: CPF (Brazilian tax identification number), first name and last name, address;
• Economic and transaction information: payment or card details (last 4 digits of VISA or MasterCard), order, return and delivery information;
• Connection data: geolocation and/or browsing (understanding which device you are using to interact with us and from which location);
• Commercial information: whether or not to subscribe to the newsletter, whether or not to create a customer account;
• Information about tastes and preferences.
Remember that when we ask you to fill in your personal information to give you access to any feature or service of the online store, we will mark certain fields as mandatory, as this is the information we need to provide you with the service or access to the feature in question. Keep in mind that if you decide not to provide this information, you may not be able to complete your customer registration or enjoy these services or features.
This data, particularly identification and shipping information, is shared with our distribution partners. Depending on the destination of the order (Mainland Portugal, Mainland Spain, or Europe – Schengen Area), the entities with which the data is shared will alternate between: NACEX, DPD, and CTT. I’M NAT reserves the right to change its distribution partners without prior notice.
Billing data is shared with I’M NAT’s billing management entity so that the respective tax invoices with tax identification numbers can be issued, or not, whenever an order is placed in our online store.
Your personal data will be processed for the following purposes:
• If you decide to register in our online store by creating a customer account, we need to process your data to identify you as a user of the online store and to give you access to its various features, products, and services available to you as a registered user. You can cancel your registered user account by contacting us.
• To contact you regarding updates or informative communications related to features, products, or services, including quality surveys and to establish a degree of customer satisfaction with the service provided.
• To manage payments for products you have purchased, regardless of the payment method used.
• Activate the necessary mechanisms to prevent and detect unauthorized uses of the Platform (for example, to prevent any fraud committed against you and/or against us). If we consider that the transaction may be fraudulent, or if we detect abnormal behavior that indicates an attempt to fraudulently use our features, products or services, this processing may result in consequences such as, for example, blocking the transaction, or deleting the user account.
• In order to provide post-purchase support: to manage any failures in product delivery, errors that occur during distribution, order changes, compensation for failures arising from I’M NAT (example: sending unsolicited products) and refunds.
• For individual or group billing purposes;
• Manage complaints, criticisms, or suggestions that reach I’M NAT;
• Personalize your experience by offering product and promotional recommendations that we believe are best for you, taking into account your history in our online store;
• If and when you subscribe to the I’M NAT newsletter, your email will be added to the database and you will start receiving exclusive information about the brand, new products and promotions via email or SMS. This will continue indefinitely until you choose to unsubscribe – you can do so at any time via the link at the end of all promotional and commercial emails or by contacting I’M NAT directly. Sending this content may involve an analysis of your consumer profile, based on your demographic data and preferences.
• By registering in our database, you also agree to occasionally receive satisfaction and quality surveys about I’M NAT’s products and services;
• Showing you digital advertising when you visit other websites or applications, including social networks. The advertising may be random or targeted and segmented for you – depending on your usage history, history with I’M NAT (visits to the online store or purchases) and general browsing. If you are a social media user, your data may be shared with platforms that I’M NAT works with so that brand advertising is displayed to you.
• We use your data to perform segment analysis and measurement of the advertising we show users on some of our partner platforms. To do this, we collaborate with these third parties who provide us with the necessary technology (e.g., cookies, pixels, SDK) to use such services. Remember that, although we do not provide personally identifiable information to these partners, we do provide them with some form of identifier each time (e.g., an advertising ID associated with the device, an identifier associated with a cookie, etc.).
• Data enrichment: When we gather your personal data from a variety of sources, we may consolidate it under certain circumstances in order to improve our understanding of your needs and preferences related to our products and services (including for analytics purposes, user profiling, marketing research, quality surveys, and improving our interactions with our customers).
• Browsing data from our online store will be processed for analytical and statistical purposes, that is, to help us understand how our users behave in our online store.
Another point to note, and while this isn’t personal information, it’s an interaction of interest to I’M NAT: by sharing a review on our online store or posting a photo/image/video on social media with the correct brand identification, you authorize us to share this material with our community through: email marketing, SMS, social media posts, or online store content.
2. LEGITIMACY FOR THE PROCESSING OF PERSONAL DATA.
The legal bases that allow us to process your personal data also depend on the purpose for which we process it, as explained below:
• Managing user registration on the platform: The processing of your data is necessary in accordance with the terms governing the use of the online store. In other words, in order for you to register as a user on the online store, we need to process your personal data; otherwise, we would not be able to manage your registration.
• Purchase and shipment of products: The processing of your data is necessary for the conclusion of the purchase contract and shipment of products. Certain data processing related to the purchase process is activated only because you request or authorize it, such as the storage of payment (card) data for future purchases. In these cases, our processing of your data is based on your own consent. We consider that we have a legitimate interest in carrying out the necessary checks to detect and prevent possible fraud, or fraudulent uses of the online store, for example, when you wish to make a purchase or return. We understand that the processing of this data is positive for all parties involved: For you, as it allows us to create measures to protect you against fraud attempts perpetrated by third parties; for us, as it allows us to prevent unauthorized uses of the online store; for all our customers and community, as it also protects your interest, ensuring that fraudulent activities are discouraged and detected when they occur.
• Customer support: We believe we have a legitimate interest in responding to requests or questions you make through the various existing contact channels. We understand that processing this data is also beneficial to you, as it allows us to provide appropriate assistance and answer your questions. When you contact us, especially for incident management related to your order or products purchased through the online store, the processing of your data is necessary for the conclusion of the purchase contract. When your request relates to the exercise of the rights we inform you about below, or to complaints related to our products or services, we are legally authorized to process your data for the purpose of complying with our legal obligations.
• Marketing: We are authorized to process your data for marketing purposes because you give us your consent, for example, when you agree to receive personalized information through various channels, or when you accept the terms and conditions to participate in a promotional campaign or to publish your photos on I’M NAT’s social networks or online store. To provide you with personalized services, or to show you personalized information, whether in our online store or in third-party stores, and also to involve you in data enrichment, we consider that we have a legitimate interest in carrying out a profile verification with the information we hold about you (such as browsing history, preferences or purchases) and the personal data you have provided to us, such as age range or language, since we understand that the processing of this data is also beneficial to you as it allows you to improve your user experience and access information according to your preferences.
3. DURATION OF DATA USAGE
Just as each type of personal information is handled in different ways, these aspects also have different data usage periods.
• Unlimited data usage until you cancel your subscription/registration: areas such as placing orders, subscribing to the newsletter, and registering in the online store involve maintaining information related to identification, billing, shipping, and finances for as long as you wish, until you delete your account or request to unsubscribe from the newsletter. This also includes website visits for statistical purposes, although after the time described below these will no longer be associated with a particular person and serve merely for counting purposes.

• Use for a period of less than 180 days: any issues relating to complaints or customer support requests will be handled for the time necessary to resolve the problem.
Regardless of whether we process your data for the time necessary to fulfill the corresponding purpose, we will subsequently keep it properly maintained and protected for as long as liabilities arising from the processing may arise, in accordance with the legislation in force at any given time. When each of the possible actions expires, we will delete the personal data.
4. DISPONIBILIZAÇÃO DE DADOS A TERCEIROS
To fulfill the purposes indicated in this Privacy and Cookies Policy, it is necessary for us to give access to your personal data to those responsible for the areas of marketing, customer support and administration of I’M NAT and to third parties who provide us with support in the services we offer, namely:
• Financial institutions
• Fraud prevention and detection entities
• Providers of analytical and technological services
• Service providers and service partners for logistics, transportation and delivery and/or partner establishments
• Service providers related to customer support,
• Service providers and collaborators related to marketing and advertising, such as social media pages, advertising agencies, or advertising partners.
5. RIGHTS AS A PROVIDER OF PERSONAL INFORMATION
We are committed to respecting the confidentiality of your personal data and guaranteeing your right to exercise your rights. With this in mind, we, the Individual Controllers, agree that you may exercise your rights free of charge by sending us an email to (hello@iamnat.pt), informing us only of the reason for your request and the right you wish to exercise.
If we deem it necessary to identify you, we may request a copy of an identification document. Specifically, regardless of the purpose or legal basis on which we process your data, you have the right to:
• Request access to your personal data that we hold. Please note that if you are a registered user of the online store, you can also view this information in the section corresponding to your customer account.
• Request that we correct the data we hold. Remember that if you are a customer account user, you can also access the section corresponding to your personal data in your account to change or update your personal data. In any case, you take into account that, by actively providing us with your personal data by any means, you guarantee that it is authentic and accurate and undertake to notify us of any change or alteration to it. Any loss or damage caused to the online store or the person responsible for the online store or any third party arising from the communication of incorrect, inaccurate or incomplete information in the registration forms will be the sole responsibility of the user. Remember that, as a general rule, you should only provide us with your own personal data, not that of third parties, unless otherwise permitted in this Privacy and Cookies Policy.
• Request that we delete your data to the extent that it is no longer necessary for the purpose for which we need to continue processing it, as explained above, or when we are no longer legally authorized to process it.
• Request that we cancel or limit the processing of your personal data, which means that in certain cases you can ask us to temporarily suspend the processing of the data or its retention beyond the necessary time. If you have given us your consent to process your data for any purpose, you also have the right to withdraw it at any time. Some of the ways in which you can revoke your consent are detailed above in the section where we explain the purposes of processing your data.
Furthermore, since the processing of your data is based on your legitimate interest, you also have the right to object to its processing.
6. CHANGES TO THE PRIVACY AND COOKIES POLICY
We may make changes to the information stated in the Privacy and Cookie Policy when we deem it necessary. If we make such changes, the user will be notified through various means via the online store (for example, through a banner, a pop-up or a push notification) or by email, when the changes in question are relevant to their privacy, so that they can review them, evaluate them and, if necessary, contest or cancel any service or functionality.
